Requirement for existing vessels (grandfather) to comply with the safety equipment requirements for new vessels
Update from AMSA 10/05/19

As previously advised:
- AMSA will work with industry in Karumba and elsewhere as to what the most appropriate flotation/liferaft requirements are for fishing vessels operating in C waters that did not need to comply with the USL Code requirement to carry a dinghy or liferaft. We sent several AMSA officers to Karumba in April this year to hear from industry on this issue. and
- AMSA will not require existing vessels to have an inflatable liferaft or install flotation until AMSA has concluded the consultation and listened to feedback from the consultation.
The intent of the 2018 changes to the NSCV was to ensure that all vessel owners started moving toward complying with the most up to date standards for safety equipment. As part of this, vessels should either have an inflatable liferaft or level flotation. We welcome news that some vessel owners have already purchased an inflatable liferaft or installed flotation. However, we understand that a more nuanced approach may be required in certain circumstances.
Vessel owners and masters have general safety duties under the law, which require them to ensure that the vessel and its operations are safe. For vessels without basic flotation, it is recommended that liferafts are used, or that persons on board wear life jackets at all times.
AMSA will ensure that our compliance partners, including Queensland Boating and Fishing Patrol officers, are kept informed of developments in this respect.
